A Court Judgment Restores Rights to Their Owners and Halts the Auction… We Create Solutions. We Don’t Wait for Them.

In a landmark real estate dispute before the Dubai Holding Committee, our firm successfully obtained a final court judgment in favor of our client, safeguarding his legitimate ownership rights in a major real estate project in Dubai that had faced suspension and legal complications.

Our client, a bona fide purchaser, faced the imminent risk of losing his land after an enforcement attachment was imposed and the property was scheduled for public auction due to legal disputes and prior nullification judgments between the developing companies, despite his full payment of the purchase price.

Through a carefully crafted legal strategy, our firm relied on the doctrine of the relativity of judgments, arguing that rulings declaring the nullity of certain transactions (such as the annulment of a gift agreement between developers) cannot be enforced against a bona fide purchaser who was not a party to those proceedings. This aligns with the well-established principle that a judgment binds only its parties, as reflected in Article (302) of the Civil Procedures Law.

By invoking Article (302), we successfully established our client’s lawful entitlement to the property and secured a stay of the auction proceedings. Ultimately, the court rendered a judgment declaring the enforcement proceedings null and void in their entirety, restoring the property to its rightful owner and protecting the bona fide purchaser who had contracted and paid the full purchase price prior to the imposition of any attachments. The ruling reaffirmed that the res judicata effect of judgments is strictly limited to their parties and cannot prejudice the rights of lawfully acquiring third parties.
